The DAAS website is a free service. No fees are charged for member registration, viewing of data/materials, or other uses of the website. DAAS seeks to become an archive that is supported through the active use of all members.

Membership Agreement

Note pertaining to "DAAS Membership Agreement" in the English version

For all information provided to members by DAAS (DAAS Membership Agreement, Privacy Policy, Personal Information Policy, etc.), that contained in the Japanese shall have priority. Please be aware that information in other languages is provided for reference purposes only.

DAAS Membership Agreement
Article 1 (General Rules)
  • The DAAS Website Use Agreement (hereinafter "the Agreement") establishes conditions for use of the website of the Digital Archives for Architectural Space (hereinafter the "DAAS Website"), which is provided by the DAAS Consortium. Use of the DAAS Website is predicated on full reading of the Agreement and acceptance of its content.
Article 2 (Definitions)
  • Terms appearing in the Agreement are defined as follows:
  • 1. "DAAS" refers to activity to archive electronic information, including photographs, drawings, architectural records, and other items, that pertains to architectural structures that comprise superior spaces and landscapes, and the system that is associated with said activity.
  • 2. "DAAS Website" refers to the website that makes information collected by DAAS available to the public via the Internet, and to the services that are provided through said website.
  • 3. "General DAAS User" (hereinafter "General User") refers to a person who uses the DAAS Website based on acceptance of the content of the Agreement.
  • 4. "DAAS Member" (hereinafter "Member") refers to an individual or corporation that has registered personal information (in accordance with the definition of the "Privacy Policy") and other information through the DAAS Website, and that has been accepted by the DAAS Office (hereinafter "the Office").
  • 5. "DAAS Curator" (hereinafter "Curator") refers to an individual or corporation that prepares and releases to the public new content using DAAS data/materials. A DAAS Member may become a Curator by submitting a Curator Registration Form and by being approved by the Office.
  • 6. "DAAS Consortium" refers to the group that manages DAAS and that handles support (in terms of both funding and labor) from companies, organizations, academic research institutes, and individuals in the form of a consortium.
  • 7. "The Office" refers to the office of the DAAS Consortium. The Office handles the administrative operation of DAAS and the DAAS Website.
Article 3 (Content of the DAAS Website)
  • 1. DAAS shall make the following content available to the public through the DAAS Website:
    (1) Architectural data/material: attribute information an architectural structure (name of work, name of architect, etc.)
    (2) Related material: data on material (photograph, drawing, sketch, etc.) linked from architectural structure data and their attribute information (date of photography, rights' holder, etc.)
    (3) Visual data/material: visual content featuring photography of architect interviews, workshops, symposia, etc., that was prepared independently by the DAAS Consortium.
  • 2. DAAS shall provide the following functions through the DAAS Website:
    (1) Comment function: a function that allows the writing of comments in architectural data/materials stored by DAAS. The writing of comments allows the accumulation of personal thoughts regarding the relevant structure. Moreover, it becomes possible to gain an indirect understanding of people's thoughts and interest regarding the relevant structure from the number of comments it has received.
    (2) Community function: a "notice board" in the form of a forum that allows people to freely exchange opinions on arbitrary themes pertaining to architecture.
    (3) Bookmark function (MyDAAS): a function for bookmarking photographs and other data/materials provided by the DAAS Website. Using MyDAAS together with communication functions (such as the DAAS community or comment functions) allows people to create a new mechanism for exchanging and sharing information through architectural data/materials.
    (4) Curator function; a function that allows people to link to or display information possessed by DAAS (architectural data/materials, related data/materials, MyDAAS, etc.) within their own websites that have been previously registered with DAAS.
  • 3. General Users may use the DAAS Website to search for and view architectural data/materials and related data/materials. However, related data/materials that can be viewed by General Users come in thumbnail form only.
  • 4. In addition to the functions useable by General Users that are stipulated in the previous Paragraph, Members may use the DAAS Website to view visual content and use the comment function, community function, and bookmark function (MyDAAS). Members may view related data/materials in a form of higher quality than thumbnails, using a display method authorized by the copyright holder.
  • 5. Members may participate in workshops and other events.
  • 6. In addition to the functions, etc., useable by Members that are stipulated in Paragraph 2, Curators may use the curator function.
  • 7. The DAAS Consortium grants the following authority to the Office for the purpose of operating and management the DAAS Website.
    (1) The authority to determine, based on its own discretion, whether or not to recognize an applicant as a Member when it receives an application for Member registration from a General User, and to grant an ID and password to the applicant should it decide to recognize the applicant as a Member.
    (2) The authority to determine, based on its own discretion, whether or not to recognize an applicant as a Curator when it receives an application for Curator registration from a Member, and to grant an ID and password to the applicant should it decide to recognize the applicant as a Curator.
    (3) The authority to determine, based on its own discretion, whether or not to register an applicant in the DAAS Community when it receives an application for Community registration from a Member, and to grant an ID and password to the applicant should it decide to permit registration.
    (4) The authority to delete content (including content made available using the comment function or community function) that is released to the public as well as to delete information pertaining to released content, based on its own discretion, should it deem that said deletion is necessary.
    (5) The authority to cancel the relevant Member or Curator ID should it deem that a Member or Curator has engaged in an act that is in violation of the Agreement, implementing the procedure stipulated in the Agreement.
    (6) The authority to use registered information other than information specified as personal information and information on usage of the DAS Website in publications that are edited, published, or sold by DAAS; presentations of academic research; etc., without notifying Members or Curators beforehand, should it deem said use to be necessary.
  • 8. The Office shall be permitted to change the content of the DAAS Website without the approval of Members or Curators in the cases provided below. Moreover, in the event that such change takes place, the DAAS Consortium shall not be required to make compensation.
    (1) When the Office determines that the change is needed to provide stable service
    (2) When the Office determines that the change is required to improve the usability of the DAAS Website
    (3) When any other reason that is socially justifiable emerges.
Article 4 (Attribution of Rights)
  • 1. Copyrights for architectural data/materials provided by the DAAS Website shall be attributed to the relevant copyright holders.
  • 2. All intellectual property rights (copyrights, patents, etc.) pertaining to overall content that is included in the DAAS Website and that the DAAS Website independently provides shall be attributed to the DAAS Consortium.
Article 5 (Obligations in Use of the DAAS Website)
  • 1. General Users are obligated to use the DAAS Website within the scope that is permitted in the Agreement.
    (1) If a General User, through use of the DAAS Website, causes damage to the DAAS Consortium, a copyright holder of data/material provided by the DAAS Website, or a third party (including damage suffered by the DAAS Consortium, copyright holder of data/material provided by the DAAS Website, or third party due to the General User's failure to observe his or her obligations under the Agreement), the General User shall take responsibility to deal with and/or resolve said damage at his or her own expense. If the DAAS Consortium receives a claim for damages from a copyright holder of data/material provided by the DAAS Website or a third party that results from an act by the General User, the General User shall compensate the DAAS Consortium for damage and expense (including legal fees within a reasonable range) suffered by the DAAS Consortium.
  • 2. Members shall have the following obligations when using the DAAS Website:
    (1) To use the DAAS Website within the scope permitted by the Agreement
    (2) To provide truthful and accurate information (including personal information) when registering as a Member
    (3) To take personal responsibility for the content of information the Member has registered
    (4) To take responsibility to deal with and/or resolve relevant damage at the Member's own expense if the Member, through use of the DAAS Website, causes damage to the DAAS Consortium, a copyright holder of data/material provided by the DAAS Website, or a third party (including damage suffered by the DAAS Consortium, copyright holder of data/material provided by the DAAS Website, or third party due to the Member's failure to observe his or her obligations under the Agreement). If the DAAS Consortium receives a claim for damages from a copyright holder of data/material provided by the DAAS Website or a third party that results from an act by the Member, the Member shall compensate the DAAS Consortium for damage and expense (including legal fees within a reasonable range) suffered by the DAAS Consortium.
    (5) To take personal responsibility to manage the ID and password granted to the Member by the Office
    (6) To use the DAAS Web on a voluntary basis, and to assume complete responsibility for said use
  • 3. Curators shall have the following obligations when using the DAAS Website:
    (1) To use the DAAS Website within the scope permitted by the Agreement
    (2) To provide truthful and accurate information (including personal information) when registering as a Curator
    (3) To take personal responsibility for the content of information the Curator has registered
    (4) If the Curator is using the DAAS Website's curator function, to mention on the Curator's own website that he or she is using said function, employing the method designated by the Office.
    (5) To take responsibility to deal with and/or resolve relevant damage at the Curator's own expense if the Curator, through use of the DAAS Website and the curator function, causes damage to the DAAS Consortium, a copyright holder of data/material provided by the DAAS Website, or a third party (including damage suffered by the DAAS Consortium, copyright holder of data/material provided by the DAAS Website, or third party due to the Curator's failure to observe his or her obligations under the Agreement). If the DAAS Consortium receives a claim for damages from a copyright holder of data/material provided by the DAAS Website or a third party that results from an act by the Curator, the Curator shall compensate the DAAS Consortium for damage and expense (including legal fees within a reasonable range) suffered by the DAAS Consortium.
    (6) To take personal responsibility to manage the ID and password granted to the Curator by the Office
    (7) To take immediate action to correct the relevant violating behavior if the Curator receives notification of a violation of the Agreement that pertains to use of the curator function or of the possibility of such a violation from the Office.
    (8) To use the DAAS Web on a voluntary basis, and to assume complete responsibility for said use
Article 6 (Prohibited Activity)
  • 1. General Users, Members, and Curators must not engage in any of the following activities when using the DAAS Website:
    (1) Activity that infringes on the copyrights, intellectual property rights (trademark rights, etc.), assets, privacy or portrait rights, or other rights of the DAAS Consortium, copyright holders of data/materials provided by the DAAS Website, or third parties, as well as activity that may constitute infringement of said rights
    (2) Activity that discriminates against or defames the DAAS Consortium or a third party or that harms the honor or credibility of the DAAS Consortium or a third party, as well as activity that is objectionable to a third party
    (3) Activity that incites or facilitate criminal or illegal behavior
    (4) Supply of part or all of the content of the DAAS Website to a third party for a fee, or activity with the intent of supplying said content for a fee
    (5) Activity to intentionally alter the content of the DAAS Website or information pertaining to said content
    (6) Activity that places or may place an excessive burden on the DAAS Website's server
    (7) Other activity not mentioned above that is in violation of the law and/or public order and morality
  • 2. Curators must not engage in any of the following activities when using the curator function of the DAAS Website:
    (1) Activity that infringes on the copyrights, intellectual property rights (trademark rights, etc.), assets, privacy or portrait rights, or other rights of the DAAS Consortium, copyright holders of data/materials provided by the DAAS Website, or third parties, as well as activity that may constitute infringement of said rights
    (2) Activity that discriminates against or defames the DAAS Consortium or a third party or that harms the honor or credibility of the DAAS Consortium or a third party, as well as activity that is objectionable to a third party
    (3) Failure to provide notation that content of the DAAS Website that is made available on the Curator's own website is content archived by DAAS.
    (4) Activity that incites or facilitate criminal or illegal behavior
    (5) Use of the DAAS Website with an ID that is other than the Curator's own ID
    (6) Supply of part or all of the content of the DAAS Website to a third party for a fee, or activity with the intent of supplying said content for a fee
    (7) Activity to intentionally alter the content of the DAAS Website or information pertaining to said content
    (8) Activity that places or may place an excessive burden on the DAAS Website's server
    (9) Other activity not mentioned above that is in violation of the law and/or public order and morality
Article 7 (Temporary Suspension and Cancellation of Curator ID)
  • 1. The Office shall be permitted, based on its own discretion, to temporarily suspend a Curator's ID should the Office determine that, based on a rational reason, the Curator engaged in an act that may violate the terms of Article 6, the Office receives a complaint from a third party stating that an act by the Curator infringed on the third party's own rights, or the Office determines that the Curator has engaged in an inappropriate act. The Curator may not object to said temporary suspension.
  • 2. In the event that the Office takes the action described in Paragraph 1, the Office shall notify the Curator that, should the Curator take steps on its own to resolve the reason for the possible violation of Article 6 within a time period to be determined based on the discretion of the Office, the Office shall terminate the temporary suspension. The Curator shall resolve the reason for possible violation of Article 6 or shall take steps on its own initiative to alter, or remove the violating portion of, its own web pages in order to prevent the possibility of said violation in accordance with the relevant notification and within the designated time period.
  • 3. In the event that the Office cannot determine that the reason for possible violation of Article 6 has been resolved or that the possibility of violation of Article 6 has ceased to exist, or in the event that the Curator does not eliminate said reason on its own initiative, within the designated time period mentioned in Paragraph 2, the Office shall be permitted to cancel the Curator's ID based on a notification to the Curator. The Curator may not object to said cancellation.
Article 8 (Suspension and Cancellation of Member or Curator Status)
  • 1. If any of the following cases apply, the Office shall be permitted to suspend or cancel Member or Curator status based, in principle, on prior notification to the relevant Member or Curator:
    (1) The Office determines that the Member or Curator has engaged in activity in violation of the Agreement
    (2) The Office determines that the Member or Curator is not suitable to be a Member or Curator
  • 2. In addition to the previous Paragraph, the Office shall be permitted to cancel the ID of a Curator without taking the measures mentioned in Article 7 should the relevant Curator engage in any of the prohibited activities mentioned in Article 6.
Article 9 (Temporary Discontinuance of DAAS Website Service)
  • 1. There may be instances in which DAAS Website service cannot be provided for a period of time due to maintenance of DAAS Website facilities or due to power outage, accident, disaster, or other cause. In such cases, the Office shall provide prior notification to Members and Curators whenever possible; however, the Office shall be permitted to omit said notification in response to unpredictable events and emergencies.
  • 2. The Office shall improve server facilities in response to usage by General Users, Members, and Curators. However, rapid changes in usage may result in instances in which General Users, Members, and Curators cannot use the service for temporary periods of time.
  • 3. In the event that a General User, Member, Curator, or third party suffers damage due to delay or interruption of DAAS Website service for any of the reasons mentioned in Paragraph 2, the DAAS Consortium shall bear no responsibility for said damage, except in cases of willful misconduct or gross negligence by the Office.
Article 10 (Content Management)
  • 1. The Office shall manage content in a form that allows identification of inappropriate use, etc., by implementing technical measures in related data/materials available on the DAAS Website.
  • 2. The Office view content on the DAAS Website at any time the Office deems necessary, and it shall have the authority to remove content in accordance with the Agreement as well as the authority to modify information pertaining to content.
  • 3. The DAAS Consortium shall have no obligation to guarantee the authenticity of content and information pertaining to content available on the DAAS Website. Information, etc., appearing in the DAAS Website is current as of the time the relevant photograph was taken or the relevant information was obtained, and therefore it may not reflect current conditions.
  • 4. The DAAS Consortium shall assume no responsibility for loss of comments that Members or Curators record in the DAAS Website, information in MyDAAS, etc. However, this stipulation shall not apply in cases in which said loss was caused by willful misconduct or gross negligence by the Office.
Article 11 (Disclaimer)
  • 1. In addition to the items stipulated in Article 7 to Article 10, the DAAS Consortium shall not be held responsible for any of the following:
    (1) When Members and Curators register personal information, comments, etc., there may be instances in which registration of comments may not be precisely executed due to the influence of server load, communications lines, etc. The DAAS Consortium shall assume no responsibility for any damage that Members or Curators suffer when such instances occur.
    (2) There may be instances in which General Users, Members, and Curators cannot use the DAAS Website service due to the influence of server load, communications lines, etc. The DAAS Consortium shall assume no responsibility for damage suffered by General Users, Members, or Curators (including indirect damage, such as loss of opportunity; the same applies t subsequent Paragraphs) when such instances occur.
    (3) In the event that a defect is discovered in the DAAS Website, the Office shall work to correct such defect as quickly as possible. However, the DAAS Consortium shall assume no responsibility for any damage suffered by General Users, Members, or Curators due to the occurrence of said defect. Likewise, the DAAS Consortium shall assume no responsibility for damage suffered by General Users, Members, or Curators arising from inability to use the DAAS Website.
    (4) If a General User, Member, or Curator suffers loss arising from default of the Office, the DAAS Consortium shall assume responsibility solely for ordinary and actual loss suffered by the General User, Member, or Curator, with the exception of instances of default by the Office that is based on willful misconduct or gross negligence. Regardless of the grounds for action, the DAAS Consortium shall have no obligation to make compensation for lost earnings or other indirect loss.
Article 12 (Changes to the Agreement)
  • 1. DAAS Members shall be permitted to delete items it has registered on the DAAS Website based on their own volition at any time.
  • 2. Posted data that are stored in the database of the DAAS Website and for which a period of time to be separately determined by DAAS has passed may be deleted during database maintenance of the DAAS Website.
Article 13 (Termination of Service)

1. The Office shall be permitted to terminate the DAAS Website service by notifying Members and Curators that it will terminate the DAAS Website service, using a method designated by the Office, at least one month prior to the termination of service.

Article 14 (Handling of Personal Information)
  • 1. The Office may gather the usage records of General Users, Members, and Curators and use these records in a technical manner when it deems that such action will improve usability of the DAAS Website.
  • 2. The DAAS Consortium shall not disclose information it obtains through Members' and Curators' entering of information and data when using the DAAS Website (including personal information of the relevant Members and Curators) to third parties other than co-users of personal data (in accordance with the stipulations of Article 2 of the Act on the Protection of Personal Information). However, the above shall not apply to cases based on request or authorization from a Member or Curator; cases when disclosure becomes necessary in rights preservation procedures of the DAAS Consortium when a Member or Curator commits an act in violation of the Agreement; cases in which obligation to cooperate with authorities in investigations or studies arises; and cases in which disclosure is demanded in accordance with a court order, law, securities exchange regulation, or securities dealers' association regulation.
Article 15 (Applicable Law and Competent Court)

1. Laws applicable to the Agreement shall be the laws of Japan. In the event that court action is initiated due to dispute with the DAAS Consortium, the Tokyo District Court shall be the exclusive competent court of the first trial.

Supplemental provision

1. The Agreement shall take effect on November 15, 2007.

DAAS privacy policy

Based on its responsibility as the organization that manages the DAAS website, DAAS takes great care to protect the personal information of all users. Specifically, DAAS manages and uses personal information based on the following guidelines; please read them before using the website. By entering personal information into the DAAS website, you are agreeing to allow DAAS to handle the entered information.

What is personal information?

DAAS defines personal information as follows: "Personal information is information pertaining to an individual. It refers to information that can identify the relevant individual, such as name, date of birth, or other notation included in said information; numbers, codes, or other symbols that are assigned to the individual; and images and sounds. (It also includes information that, while not sufficient to identify the individual alone, can be used easily in comparison with other information to identify the individual.)"

Responsibility for personal information management

DAAS shall take responsibility for managing personal information.

Purpose of collecting personal information

DAAS collects personal information to the extent necessary to allow access to the DAAS website based on users' consent.

Use and supply of personal information

DAAS shall not use or supply personal information for purposes other than that mentioned above. If it becomes necessary for DAAS to use or supply personal information for a purpose other than that mentioned above, DAAS shall do so only after notifying and gaining the consent of the relevant individual.

If personal information is not provided to DAAS

Whether or not to register personal information when using DAAS website member services is left to the discretion of individual DAAS members. However, if a member does not enter the required items for each member service, the member will not be able to use the relevant member service.

Display, correction, and deletion of personal information

DAAS members may ask DAAS to display their registered personal information at any time. Correction and/or deletion of personal information can be performed at any time from the confirm/edit registered information webpage. Any questions regarding the use of these functions can be directed to DAAS using the Inquiry Form.

Outsourcing

DAAS may entrust personal information to an outsourcing partner when it outsources management of personal information. When DAAS engages in outsourcing, it will select its outsourcing partner based on the condition that the partner has secured a sufficient level of personal information protection, and then DAAS will sign a nondisclosure agreement with the partner.

Management of personal information

DAAS will work to continually implement necessary safety measures in terms of both technology and organization in order to respond to risks of inappropriate access to personal information as well as of loss, destruction, manipulation, or leakage of personal information.

Changes to this document

DAAS will regular review the content of this document and may change its content without prior notification.
